Article 1: Definition of the Service
The term “the client” refers to any individual (private or professional acting on behalf of a company) making a reservation on the website paris-chauffeur-limousine.com.
The term “the passenger” refers to any beneficiary of the service ordered.
The package includes: a fully operational vehicle, a driver with the skills required for the requested service, professional insurance for transported persons, fuel, kilometers, and time according to the quotation, departure and return to the garage (Paris 75016), and the options defined with the client. Times and/or kilometers are calculated from the vehicle’s departure and return to the garage, following the pricing (unless specific conditions apply). Any pricing unit (hour, kilometer) started is due. Our prices are VAT-inclusive (All Taxes Included, with VAT at 10%, subject to adjustments in case of legislative and/or regulatory changes) and expressed solely in EUROS.
Unless otherwise stated on the order form, the package does not include toll and parking fees, entrance fees to public places, phone communication charges, meal and accommodation allowances for the driver.
For all services, except transfers, including the time slots between 11:30 a.m. and 2:00 p.m. or 7:00 p.m. and 9:00 p.m., a driver meal fee of €22.00 (non-VAT applicable) will be charged in addition.
Article 2: Payment
For any booking, a minimum deposit of 30% of the service price will be collected. The balance of the payment, unless otherwise agreed by the company Faubourg Particulier, must be made 48 hours before the service. In all cases, the service requester and the signatory of the order form are solely responsible for its payment in case of default by the user.
In accordance with Law No. 92-1442 of December 31, 1992, all our services are payable in cash by individuals and companies. No discount is granted for early payment. In case of payment after the date indicated on the invoice or receipt, late payment interest will be charged, amounting to no less than three times the legal interest rate applied prorated temporis.
Subject to our approval, payment may also be made in cash at the end of the service. For long-term services and account clients, invoice payment may be made weekly or on a different periodic basis stipulated in writing, sent at the end of the month of the service(s) by email or mail to the provided address.
For certain services, a security deposit may also be required. Rates are subject to change without notice (except for account clients and long-term services). Quotes issued by our sales department are valid for thirty days. By express agreement, and unless an extension is requested in time and accepted by us, failure to pay a single installment will render all due amounts immediately payable. This includes an indemnity equal to 15% of the due amounts, in addition to legal interest and any legal fees.
In case of payment delays, our company reserves the right to suspend or cancel ongoing service orders without prejudice to any other recourse.
Article 3: Cancellation
Any cancellation made by the client for any reason will result in the loss of the deposit as a fixed and irrevocable indemnity. Cancellation must be sent at least 72 hours before the start date of the service by email to the sales department of Faubourg Particulier, whose contact information is available on the website paris-chauffeur-limousine.com.
Reservations canceled on the day of the service, before the vehicle departs the garage, or in the event of the client’s absence at pickup, will be charged. If canceled 24 hours before the service, 50% of the ordered service will be charged.
Article 4: Unavailability
If the company is unable to provide the vehicle specified in the contract, all sums already paid will be fully refunded without any recourse or indemnity for the inconvenience caused. However, the deposit will be retained if both parties agree on the provision of an alternative vehicle.
In the event of a breakdown or accident during the service that renders the vehicle unavailable, the service amount will be calculated pro rata to the time used, without any recourse or indemnity for the inconvenience caused.
Faubourg Particulier reserves the right to subcontract its services to referenced companies.
Article 5: Recourse and Indemnity
No recourse or indemnity for inconvenience caused by vehicle delays (strikes, demonstrations, weather conditions, significant traffic difficulties) will be accepted unless both parties agree to an amicable settlement of the contract.
In any case, in the event of damages caused by delays (e.g., missed flights), Faubourg Particulier limits its liability to the cost of its transport package.
Article 6: Safety and Damages
The driver must comply with traffic regulations and is prohibited from violating them (speed limits, one-way streets, failure to yield) even at the request of the passenger(s), including in cases of extreme urgency.
In the event of damage to the vehicle’s interior equipment or other damages caused to the vehicle or others (e.g., due to sudden door opening), the client will bear the cost of the damage. If the vehicle is immobilized for repairs exceeding one day, a minimum charge of €150.00 (excluding VAT) will apply depending on the vehicle category.
For safety reasons, the driver is responsible for opening and closing the vehicle doors. Smoking is prohibited inside the vehicles in accordance with the law of September 17, 1977. Drivers are instructed to stop to allow smokers to take breaks if requested.
If the client uses narcotics, the driver is instructed to immediately terminate the ongoing service. This termination will not entitle the client to any refund.
Pets are not allowed in the vehicles unless prior agreement is obtained, and the animal is in a cage or sealed container.
Article 7: Carrier Liability
The carrier’s liability is expressly waived in cases where the client fails to comply with transportation regulations.
Monetary fines, penalties, or material and bodily damages to third parties or the vehicle resulting from negligence by the client, the user, their staff, or their guests, as well as from orders given to the driver despite warnings, will be borne solely by the client, who accepts full responsibility and consequences.
This includes but is not limited to valuable objects left in the vehicles, damage to interior or exterior equipment, sudden door openings, exceeding the vehicle’s seating capacity or load limit, route instructions contrary to established safety procedures, and requests in violation of French and EU regulations, particularly the Highway Code.
Baggage volume must align with the vehicle’s capacity. Baggage is accepted up to 20 kg per person and remains under the passenger’s responsibility. We are not liable for forgotten items in our vehicles or elsewhere during the service.
Service timelines provided by our customer service or drivers are indicative only. In accordance with Article 133-2 of the French Commercial Code, delays during trips do not give rise to damages, although we consistently aim to minimize such occurrences.
Article 8: Disputes
Subject to legal provisions, any dispute arising will be, by express agreement, under the exclusive jurisdiction of the Paris Commercial Court or any other jurisdiction chosen solely by Faubourg Particulier.
